Accuwriter Inc. and our affiliated companies (together with its affiliates and subsidiaries, collectively, “Accuwriter,” “us,” “we,” or “our”) recognizes that privacy and security are concerns for itself and individuals accessing our websites or applications. We value our relationship with you and place the highest importance on respecting and protecting the privacy of our customers, suppliers and other third parties. This Privacy Policy applies to all Accuwriter sites, products and services that display or link to this Privacy Policy owned and operated by Accuwriter, and describes how Accuwriter collects and uses the personal information you provide.
This Privacy Policy operates in conjunction with our Website Terms of Use as well as our Application Terms of Use, End User License Agreements, Master Services Agreements, Terms of Service and Subscription Agreements, and other agreements or service plans (each an “Agreement”) with individuals or businesses (e.g., your employer) that use or interact with our products or services (each such business, together with its employees and other authorized users, a “Client”).
This Privacy Policy describes the types of information we may collect from individuals (“you” or “your”) that visit, download, install, or use our publicly available websites (the “Websites”), our online applications (the “Web Applications”), or our mobile applications for the iOS and Android operating systems (the “Mobile Applications”) or any Hardware, Software, or Services as those terms are defined in an applicable Agreement (collectively, the “Platform”) and the reasons we collect that information. By using the Platform, you authorize us to collect and use your information as set forth in this Privacy Policy and any applicable Agreement. Such Agreements may further restrict and limit the way in which we collect, use, and share personal information provided by our Clients through or in connection with their use of our products and services to which they subscribe.
Any revisions to this Privacy Policy will be posted to the Platform. Your continued use of the Platform after we post such changes will constitute your acceptance of the revised Privacy Policy to the extent permitted by law.
1. Information we collect
We collect “Personal Information” for proper business purposes and to fulfill our contractual obligations to our Clients. Personal Information includes information that may be used to identify, locate, or contact you, such as your name, title, company, address, e-mail address, and phone numbers, as well as information that reasonably can be related or linked to a particular individual or a household, including through an IP address, such as relationship information regarding services we provide or may provide to you, information about how you use the Platform, and information about the device(s) and networks that you use in conjunction with the Platform, such as login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, device type, browsing history with respect to the Platform for each device, referring websites, emails, or other electronic communications, and search terms. If you use one of our products or services that offers or depends upon location awareness, we will also collect geolocation information about you.
We may also collect credit card or bank account information to process your payments and information that you provide by filling out forms on our Website. This includes information provided at the time of purchasing our products and/or services. We may ask you to answer some optional questions about yourself and your business and how you use the product. We may also ask you for information when you report a problem with our Website, product or service.
We collect your biometric data in the form of facial scans and facial mapping when using a biometric login feature to access the Platform. We may also collect recordings of your voice if you call us. We use this information to verify that your ID is real, to protect your personal information from unauthorized disclosure, and to prevent fraud. We will not collect, use, or store your biometric data without your consent. We will not sell, lease, trade, or otherwise profit from your biometric data. We will only disclose your biometric data or share the data with our contractors to provide the products or services you request. When a valid legal request is made, we may also share the biometric data with law enforcement when requested to do so. We will store, transmit, and protect your biometric data using the same degree of reasonable care as similar confidential and sensitive information.
You should discontinue use of the Website and the products or services if you do not wish to share this information with us. Unless otherwise required by law, Personal Information does not include publicly available information or aggregated or deidentified information that cannot be used to identify you individually or reasonably be re-associated with you.
2. Third-Party websites and links
When you are on our Platform and are asked for personal information, you are sharing that information with us. However, our Platform may contain various links to third-party websites. These sites may provide information, goods, services and promotions that are separate from and in addition to our information, goods, services and promotions. These sites are owned and operated by third parties and not by us. As such, any information you provide to these third-party websites will be subject to their data collection practices and governed under the terms of their privacy policy. All questions, comments, and concerns regarding third party websites and links should be directed to the third party directly.
3. How information is collected and used
If you submit information to us through the Platform, including account information, then we use this information to operate, maintain, and provide the features and functionality of the Platform. By providing your email address to us, you consent to our using the email address to send you Service-related notices, including among other things notices required by law. You may not opt out of Service-related e-mails. We may also use your email address to send you other messages, including changes to Service features and special offers. Additionally, we use your information for:
- Processing your requests regarding the Platform and our products or services.
- Providing customer assistance or technical support and solving problems or disputes relating to auctions or claims.
- Customizing content, providing recommendations and enhancing the quality of the Platform, including presenting content in the most effective manner for the browser or device you use to access the Platform.
- Maintaining, operating, improving and developing the Platform and related content, products or services.
- Learning about you and others interact with and respond to the Platform, including by measuring and optimizing usage, reliability and performance, conducting market research, analyzing trends, and supporting our operations.
- Sending you informational messages about the Platform.
- Delivering marketing or promotional communications, including offers or promotions about our or third parties’ products and services.
- Responding to your questions or addressing your requests.
- Communicating with you about, listings, bids, promotions or events.
- Developing, managing and conducting advertising and marketing campaigns, promotions and offers and other initiatives.
- Detecting, preventing and responding to fraud or potentially illegal activities, misuse of the Platform, intellectual property infringement or other violations of law, this Privacy Notice, our Terms of Use or other applicable policies.
- Performing audits, assessments and testing or troubleshooting activities.
- Complying with and enforcing applicable industry and legal requirements (including legal process such as court orders, warrants or subpoenas) and fulfilling contractual obligations.
We may collect and use Personal Information in a variety of ways depending on the context of the collection. The table below describes the purposes for which we collect information and the lawful basis for each purpose.
Provision of Sites, Apps, products, and services:
providing our Sites, Apps, products, or services; providing promotional items upon request; and communicating with you in relation to those Sites, Apps, products, or services.

Communicating with you via any means (including via email, telephone, text message, social media, post or in person) to provide news items and other information in which you may be interested, subject always to obtaining your prior opt-in consent to the extent required under applicable law; personalizing our Sites, products and services for you; maintaining and updating your contact information where appropriate; obtaining your prior, opt-in consent where required; enabling and recording your choice to opt-out or unsubscribe, where applicable.

Product safety communications:
Communications in relation to product safety, including product recalls and product safety advisory notices

- We have a legitimate interest in carrying out the Processing for the purpose of ensuring the safety, and proper use, of our products (to the extent that such legitimate interest is not overridden by your interests, fundamental rights, or freedoms).
Management of IT systems:
Management and operation of our communications, IT and security systems; and audits (including security audits) and monitoring of such systems.

Sales; finance; corporate audit; and vendor management.

Engaging with you for the purposes of obtaining your views on our Sites, our Apps, our products, or our services.

Detecting, investigating and preventing breaches of policy, and criminal offences, in accordance with applicable law.

Recruitment activities; advertising of positions; interview activities; analysis of suitability for the relevant position; records of hiring decisions; offer details; and acceptance details.

We may also collect publicly available information about you by conducting searches of public records (e.g., Companies House, electoral roll, DVLA database, Member’s registers of industry bodies we are entitled to search as another member, Lead Forensics, Risk Disk, Experian, Social Media platforms, Mail Preference Services, Telephone Preference Services, or Tender Announcement Services).
4. Information We Collect Through Automatic Data Collection Technologies
As is true of most websites, we gather certain information automatically and store it in log files. This information may include Internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data.
We use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application.
We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third-party partners may use cookies or similar technologies to provide you advertising based upon your browsing activities and interests. These third-party cookies and other technologies are governed by each third-party’s specific privacy policy. To learn how to opt out of this type of advertising please see “Choices about how we use and disclose your information” below.
We and our partners use cookies or similar technologies to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer. Users can control the use of cookies at the individual browser level. We use cookies for the following purposes:
- Strictly Necessary cookies. These are cookies that are required for the operation of the Platform. They include, for example, cookies that enable you to log into secure areas of our website, use a shopping cart, or make use of e-billing services.
- Analytical or Performance cookies. These cookies allow us to recognize and count the number of visitors to the Platform and monitor usage at a collective level.

- Targeting or Tracking cookies. These cookies record your usage of the Platform in order to make our content and advertising more relevant to your interests. We may also share this information with third parties for this purpose.
COOKIES AND SIMILAR TECHNOLOGIES
A “cookie” is a small text file that websites send to your computer or device other Internet-connected device to identify your browser or to store information or settings in the browser. A “web beacon”, also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.
Our sites use cookies, web beacons, java scripts, and similar technologies to automatically collect certain information about your activity relating to your visit to our sites. These technologies collect your Internet Protocol (IP) address, network location, time/date stamp, referring site details, browser type, referring/exit pages, operating system, and/or clickstream data. Behavioral Tracking/Third Party Cookies

Your Internet browser may let you restrict or disable certain types of cookies. Without cookies, you may not be able to use all of the options on our sites.

Sometimes we use technology to collect the information that your browser uses to auto-fill. We use this to tell you if there is a mistake in registration or if the registration cannot be submitted. You can stop this technology by turning it off in your browser, and you will still be able to use all of the options on our sites.

These cookies are likely to record your browsing activity, which may include your usage of our Platform. You can clear or adjust settings related to cookies at any time using your web browser.
We treat information collected by automatic data collection technologies as Personal Information when it is associated with or stored in a way that can be reasonably associated with identifiable Personal Information we collect in other ways. While our Platform currently does not recognize Do Not Track signals from your browser, we do provide information below about how to manage your choices and preferences related to online tracking. Additionally, you may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, please note that some parts of the Platform may become inaccessible or not function as intended.
5. Collection of Information in Mobile Applications
When using mobile applications and services, we may collect personal information from you such as your phone number, mobile device type, carrier, name, email address, and physical address, as well as the mobile number, device info and location data. We use this information in order to set up and manage your account as well as contact you about your services. If you use location-enabled products and services, you may be sending us location information. This information may or may not reveal your actual location. You may opt-out of location-based services at any time by editing the setting at the device level. We use your information to process and personalize your requests. We also use the information for support, to develop new features, and to improve the overall quality of our products and services. We may also use the information to show you a history of your activity, to provide you with statistics about you or your use of our product or service, or to provide you with a better user experience. We may also use your information to contact you about special offerings that may interest you. If you sign up for a mobile message service, you will have the opportunity to stop receiving mobile messages by following the instructions in the message.
Your mobile service provider may be required to monitor your messages for inappropriate content, and that provider may pass on that monitoring obligation to us. To fulfill these requirements, we may monitor your mobile messages for inappropriate content.
If you sign up for our mobile messaging service, through which you have the ability to send mobile messages to other individuals or businesses, you are required to follow all applicable laws, including unsolicited communication laws.
If you sign up for a third-party application or service, we may share information about your mobile device in order to provide the service you requested. Your carrier may have access to information we collect. We suggest that you review your carrier’s privacy statement and the privacy statements for any third-party applications or services you use.
6. Information Sharing
It is our policy not to provide your Personal Information to third parties except as outlined in this policy or unless we have your prior consent. We may provide Personal Information to our affiliates, to our own auditors or other service providers, or to third party vendors whose services are integrated into our Platform in order to provide the services we offer or upon whom we rely on to operate and market our business. These include those sub-processors listed at the link found here, and other selected third parties to the extent we reasonably consider the disclosure to be necessary for our legitimate business interests or in your best interest.
Before we disclose information to third parties, we contractually require the recipients to use such information solely for purposes related to providing the services requested and to provide at least the same level of data protection as described in this Privacy Policy. We may also disclose Personal Information or in connection with negotiations to buy or sell any business or its assets, but only to the extent reasonably necessary given the context, and may also disclose aggregated and other non-personal information, including user statistics, to describe our Platform to prospective business partners, advertisers, and other third parties.
We may disclose, access, or report personal information when we believe, in good faith, we are required to by law or to protect our legal rights. We may also do this in connection with an investigation into a suspected violation involving the Terms of Service, fraud, intellectual property infringement, or other activity that may be illegal or expose us to legal liability. For example, we may be required to disclose personal information to cooperate with regulators or law enforcement authorities or to comply with a court order, subpoena, search warrant, law enforcement request, or similar legal process.
We work with other companies or developers to provide you with products and services, which we clearly identify. Either we or the other company may offer these products and services. We clearly identify these co-branded products and services. In some cases, we exchange customer usage information to establish and provide ongoing service. By requesting these products or services, you are permitting us to provide your personal and usage information to the other company. If you do not want your information shared with these co-branded products, you can deactivate your account by going to your profile or contacting us on the information below.
We also may share information about our users with third parties, such as advertisers or partners, for marketing and promotional purposes. Our Websites may provide links to third-party sites, such as those of our business partners and online advertisers. These could include other services, promotions or sweepstakes offered by business partners. Because we do not control the information policies or practices of these third parties, you should review their privacy policies to learn more about how they collect and use personal information.
Accuwriter uses Google’s Application Programming Interface (API) Services to log Gmail interactions you have with Accuwriter’s customer relationship management software (CRM). Accuwriter’s use and transfer to any other app of information received from Google APIs will adhere to the Google API Service User Data Policy, including the Limited Use Requirements. Your Google information is used by our system developers to provide or improve user-facing features that are prominent to your user experience. Accuwriter policies and procedures define requirements that prohibit the unauthorized use of data within the Platform.
7. Privacy Information for Client Personnel
In order to provide our products and services to our business Clients using the Platform, we may collect Personal Information about such Client’s current, prospective, and former employees, representatives, and other personnel (collectively, “Client Personnel”). We may receive this Personal Information from our business Clients or directly from Client Personnel. we will disclose Personal Information about Client Personnel as directed by the relevant Client including through any applicable Agreement with the Client and other entities that may be required for us to deliver our products and services to the Client. Any such entities are contractually bound to limit use of Personal Information as needed to perform the services requested. We may also disclose Personal Information of Client Personnel when required to do so by law, such as in response to a subpoena or court order. We will at all times maintain reasonable and appropriate security controls to protect personal information of Client Personnel, as described under Data Security below.

8. Choices about how we use and disclose your information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:
Tracking Technologies and Advertising. In many cases, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Each browser is different, so visit the “help” section of your browser to learn about cookie preferences and other privacy settings that may be available. If you disable or refuse cookies, please note that some parts of our Platform may then be inaccessible or not function as intended. Promotional Offers from the Company. If you do not wish to have your contact information used by us to promote our own products or services, you can opt-out by sending an email stating your request to office@Accuwriter.com. If we have sent you a promotional email, you may request to be omitted from future emails by sending us a return email or pressing the button provided. This opt out will not apply to our use of information provided to us as a result of a product or service purchase, warranty registration or other transactions.
Targeted Advertising. Third party advertising companies may place cookies on your computer when you visit our website or other websites so they can display targeted interest-based advertisements to you. This Privacy Policy does not cover the collection methods or use of the information collected by these third parties. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website at www.networkadvertising.org.
Google Analytics. We use Google Analytics to monitor and improve our user experience. You can opt out of Google Analytics without affecting how you visit our site. For more information on opting out of being tracked by Google Analytics across all websites you use, visit https://tools.google.com/dlpage/gaoptout.
9. Accessing and correcting your information
You have the right to amend or update inaccurate or incomplete personal information, request deletion of your personal information, or request that we no longer use it. Upon request we will provide you with information about whether we hold or process on behalf of a third party, any of your personal information. You may change your account and contact information any time by logging into your account or by emailing office@Accuwriter.com. We will respond to your request within a reasonable timeframe. To change your mobile contact preferences, follow the instructions in your SMS or other mobile message.
10. Your Privacy Rights
Privacy rights vary depending on where you reside, but we will make reasonable efforts to honor your request even if you are a resident of a country or state that does not require us to do so under applicable law. You may have the following privacy rights under applicable state laws:
- Right to Know: you may have the right to request information about the Personal Data we have collected about you and for what purpose.
- Right to Access: you may have the right to request information about how we process your Personal Data and to obtain a copy of that personal information in a readily useable format (to the extent “technically feasible”).
- Right to Portability: to the extent technically feasible, you may have the right to receive your Personal Data, in a structured, commonly used, and machine-readable format and to have that information transmitted to another organization in certain circumstances.
- Right to Correct Inaccuracies: you may request that inaccuracies in your Personal Data be corrected, considering the nature of the data and the business’ purposes in using it.
- Right to Deletion: you may have the right to request the deletion of your Personal Data that we have collected from you.
- Right to Be Free from Discrimination: we will not discriminate against you for exercising your consumer privacy rights.
- Right to Opt-out of Sharing: you may have the right to opt out of us sharing your Personal Data with third parties for some purposes, including sharing that may be defined as a sale under certain laws.
- Right to Make Choices About Email Marketing: you may have the right to make choices about receiving email marketing.

11. California Privacy Rights
California Civil Code Section § 1798.83 permits users of the Platform that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
California residents are entitled to request and obtain from us once per calendar year information about any of your personal information shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information. We do not (and do not intend in the future) to sell your personal information.
To request more information about the Personal Information collected about you in this context in the last 12 months, or to request deletion of your Personal Information, please see the “How to Contact Us” section found below. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information, and access requests may only be made twice within a 12-month period. We must be able to verify your identity in order to comply with your requests under the CCPA. To do so, we will seek to associate the information provided by you when making your request with personal information we have collected about you previously. We will endeavor to respond to valid verifiable consumer requests within 45 days of receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We may not and will not discriminate against any California consumer for exercising any of the rights described in this section – including by charging differential pricing.

We have implemented reasonable, risk-based technical and organizational measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where you have chosen a password for access to certain parts of the Platform, you are responsible for keeping this password confidential.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Application by any third party unless the circumvention was the result of our gross negligence or willful misconduct.
